Court pulls up SIT for failing to produce investigation records

AHMEDABAD - A Judge of Ahmedabad Session Court hearing Gulberg Society Massacre trial, Monday, pulled up SIT for withholding investigation records from the session court despite repeated orders to produce it.

The Session Court Judge BJ Dhanda, reacting sharply to the SIT's approach, pulled up advocate Jambuar , counsel of SIT, for withholding investigation records from the Sessions Court despite two orders issued by him on different occasions.

"Why the SIT is in open hostility and opposition to the victim witnesses who are assisting the prosecution?" the Judge asked SIT prosecutor.

Incensed Judge also refused to recall his previous orders on the request of SIT defense Jambuar and said, "SIT cannot play games with the Court by bringing in different advocates at different hearings."

He also directed that the SIT advocate should take instructions from special public prosecutor RC Kodekar as to what had happened on earlier dates and set 27 June as final date to place all required documents before the court.

The victim witnesses of Gulberg massacre, since January 2010, have been arguing to get former Joint Commissioner of Police MK Tandon, the then DCP Gondia and other policemen arraigned as accused.

Subsequently the victim-witnesses, in November 2011, also had filed applications for documents related to the conspiracy and involvement of top policemen and politicians in it. Consequently, the Judge BJ Dhanda, on 9 November 2011 and 11 April 2012 had directed SIT to present investigation records to the Court and same was assured by the Special Public Prosecutor RC Kodekar.

The Court had deferred the decision on this application on grounds that the SIT is still investigating their role.
